1. Acceptance of Terms
By accessing or using AusPharm CPD ("the Platform"), you agree to these Terms and Conditions. If you do not agree, you must not use the Platform.
2. Service Description
The Platform provides tools for pharmacists to record, organise, and report CPD activities, including dashboards, planning tools, and export features. The Platform is an organisational aid and does not replace professional or regulatory judgment.
3. Eligibility and User Accounts
You must provide accurate account details and keep your login credentials secure. You are responsible for all activity under your account. You must notify support promptly if you believe your account has been accessed without authorisation.
3A. Credential Security
You must maintain the confidentiality of your password and any authentication methods linked to your account. You must not share account access with others. You must notify us as soon as practicable if you suspect compromised credentials or unauthorised access.
4. User Responsibilities
- Maintain accurate and truthful CPD records.
- Ensure uploaded content (including certificates) is lawful and relevant.
- Comply with all applicable professional, legal, and regulatory requirements.
- Use the Platform only for legitimate professional use.
5. CPD Compliance Disclaimer
The Platform is designed to support CPD management, but it does not guarantee compliance with AHPRA, Pharmacy Board standards, or any other legal or professional obligations. You remain solely responsible for meeting your CPD and registration requirements.
6. Data and Content
You retain responsibility for content you enter or upload. You grant AusPharm CPD a limited licence to store, process, and display that content only as required to provide the service.
If you choose to share an activity to the CPD Database, only core activity information is shared. Private fields such as reflections are not intended to be shared through that feature.
6A. Backup Responsibility
While we implement operational safeguards, you remain responsible for keeping your own backup copies of important records, including CPD evidence and certificates. The Platform should not be treated as your sole long-term repository for critical compliance records.
7. Privacy and Security
Your use of the Platform is also governed by the Privacy Policy. We implement reasonable technical and organisational safeguards, but no system can be guaranteed fully secure. You acknowledge this residual risk when using online services.
7A. Third-Party Services
The Platform may rely on third-party infrastructure and software providers for hosting, authentication, storage, security, analytics, and communications. We are not responsible for outages or failures caused by third-party providers beyond our reasonable control.
8. Availability and Changes
We may modify, suspend, or discontinue part or all of the Platform at any time, including feature changes, maintenance windows, and security updates. We may also update these Terms from time to time. Where changes are material, we will provide notice by posting an updated version on the Platform and/or by account email. Continued use after the effective date constitutes acceptance of the updated Terms, subject to applicable law.
8A. Communications
You agree to receive service communications that are necessary for account operation, security, billing, and legal notices. Marketing communications (if any) will include an opt-out option where required by law.
9. Prohibited Use
- Attempting to bypass security controls or access unauthorised data.
- Uploading malicious files, harmful code, or unlawful content.
- Using automated tools to scrape, overload, or disrupt the service.
- Impersonating another person or misrepresenting credentials.
10. Suspension and Termination
We may suspend or terminate accounts that breach these Terms, present security risks, or involve misuse of the Platform. Users may stop using the Platform at any time and may request account deletion where available.
Where practicable, we will provide notice before suspension or termination. Immediate suspension may occur without prior notice where needed to protect security, legal compliance, or other users. Where appropriate, we may provide a remediation path for reinstatement. Following termination, access to data may be limited or removed after a reasonable operational period.
10A. Subscription, Billing, and Renewal
Paid access is offered at AU$75 per year (including GST) on a 12-month minimum term, with automatic renewal unless cancelled in accordance with your account settings or applicable notice requirements. You authorise us and our payment providers to charge applicable fees, taxes, and recurring subscription amounts. Unless required by law, fees are non-refundable for partial billing periods.
Cancellation requests must be submitted through the account workflow or support channel identified on the Platform. Cancellation takes effect at the end of the current paid billing period unless otherwise required by law. If cancellation occurs during the minimum term, remaining committed charges may still apply as permitted by law.
10B. Failed Payment
If payment cannot be processed, we may retry payment, suspend access to paid features, or terminate the subscription after reasonable notice.
10C. Billing Errors and Disputes
If you believe a charge was made in error, contact support promptly with transaction details. We will investigate in good faith and, where appropriate, issue corrections, credits, or refunds in accordance with applicable law and payment provider requirements.
11. Intellectual Property
All software, design, branding, and non-user content on the Platform are owned by or licensed to AusPharm CPD and are protected by applicable intellectual property laws. You may not copy or redistribute Platform materials except as permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, AusPharm CPD is not liable for indirect, incidental, or consequential loss, including loss of data, business interruption, or compliance outcomes. Our aggregate liability is limited to the amount paid by you (if any) for use of the service in the 12 months prior to the claim.
13. Warranties
The Platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted availability, absolute accuracy, or fitness for a particular purpose beyond non-excludable rights under applicable consumer law.
13A. AI-Assisted Features and Uploads
Where AI-assisted features are provided (including document processing or extraction workflows), outputs are generated automatically and may contain errors. You are responsible for reviewing and verifying all imported or generated content before relying on it for professional or regulatory purposes.
14. Governing Law
These Terms are governed by the laws of Australia and the applicable laws of the State or Territory in which the service provider is based, unless otherwise required by law. Subject to non-excludable rights, courts of that State or Territory have non-exclusive jurisdiction over disputes arising from these Terms.
14A. Events Outside Reasonable Control
We are not responsible for delay or failure to perform obligations caused by events outside our reasonable control, including telecommunications failures, cloud provider outages, cyber incidents, industrial actions, natural disasters, and government actions.
